1 Acceptance of Terms

By accessing the website sunexo.shop, placing orders, making reservations, dining at Sunexo Restaurant (Shop No. 28, Connaught Place Inner Circle, New Delhi, Delhi 110001), or using any of our services, you agree to be bound by these Terms and Conditions in their entirety. If you do not agree with any part of these terms, you must not use our services. These terms constitute a legally binding agreement between you ("User," "Customer," or "Guest") and Sunexo Restaurant ("we," "our," or "us").

2 Services Offered

Sunexo Restaurant provides the following services:

• Dine-In Services: Seated dining experience at our physical restaurant location at Connaught Place, New Delhi, including à la carte menu, set menus, chef's specials, and beverage services.
• Online Ordering: Food ordering through our website sunexo.shop for delivery or pickup, subject to delivery zone availability and minimum order requirements.
• Table Reservations: Online and phone-based reservation booking for dine-in services, subject to availability and confirmation.
• Catering & Events: Customized catering services for private events, corporate functions, weddings, and celebrations, arranged through prior consultation and agreement.
• Gift Vouchers: Purchase and redemption of Sunexo gift vouchers, subject to specific terms mentioned on the voucher.

3 Ordering & Payment

• All online orders are subject to acceptance and confirmation by Sunexo Restaurant. We reserve the right to refuse or cancel any order for any reason, including unavailability of items, technical errors, or suspected fraudulent activity.
• Prices displayed on our website and menu are in Indian Rupees (INR) and are inclusive of applicable taxes unless stated otherwise. Prices may change without prior notice, but confirmed orders will be honored at the price at the time of order placement.
• Payment must be made at the time of ordering through our accepted payment methods including credit/debit cards, UPI, net banking, wallets, or cash on delivery (where available).
• In case of payment failure after order confirmation, the order will be automatically cancelled, and any amount debited will be refunded within 5-7 business days to the original payment method.
• A delivery fee may apply based on the delivery distance and order value. This fee will be clearly displayed before order confirmation.

4 Delivery & Pickup

• Delivery is available within specified zones in New Delhi. Delivery zones and estimated delivery times are indicated on our website and may vary based on demand, weather conditions, and traffic.
• We aim to deliver within the estimated time frame, but delays may occur due to circumstances beyond our control. We shall not be liable for any inconvenience caused by reasonable delays.
• If the delivery address provided is incorrect or the customer is unreachable after multiple delivery attempts, the order may be cancelled without a refund.
• For pickup orders, customers must collect their order within 30 minutes of the notified ready time. Orders not collected within this window may be disposed of without a refund.
• All food items are packaged in food-grade, tamper-evident containers. We recommend consuming delivered food within 1 hour of delivery for the best taste and safety experience.

5 Cancellation & Refund Policy

• Online Orders: Cancellation requests must be made within 5 minutes of order placement. Once the kitchen has started preparing your order, cancellation is not possible, and no refund will be issued.
• Reservations: Table reservations may be cancelled or modified up to 2 hours before the reserved time. No-shows or late cancellations may incur a cancellation fee of ₹500 per person for parties of 6 or more.
• Refunds: Eligible refunds will be processed within 5-7 business days to the original payment method. Refund requests must be raised within 24 hours of the order/delivery.
• Quality Issues: If you receive a damaged, incorrect, or unsatisfactory order, please contact us immediately at +91 71444 75623 or info@sunexo.shop with photographs. We will arrange a replacement, credit note, or refund at our discretion.

6 Allergies & Dietary Information

While we make every effort to provide accurate allergen and dietary information on our menu and website, Sunexo Restaurant cannot guarantee that any food item is completely free from allergens including but not limited to nuts, dairy, gluten, shellfish, eggs, and soy. Our kitchen handles all these ingredients, and cross-contamination may occur.

It is the customer's responsibility to inform our staff of any allergies or dietary restrictions before placing an order. We will make reasonable efforts to accommodate your requirements but cannot accept liability for any adverse reactions. Customers with severe allergies should exercise caution and consume food at their own risk.

7 Dine-In Conduct

• Guests are expected to maintain appropriate conduct and decorum consistent with a fine dining establishment. We reserve the right to ask any guest to leave who behaves in a disruptive, abusive, or inappropriate manner towards our staff, other guests, or property.
• Outside food and beverages are strictly not permitted inside the restaurant premises.
• Smoking is strictly prohibited inside the restaurant as per Delhi government regulations. Designated smoking areas, if available, must be used.
• Children must be accompanied by a responsible adult at all times. We provide high chairs on request for young children.
• Guests are responsible for any damage caused to restaurant property. The cost of repair or replacement will be charged accordingly.
• Reservation timings are honored for a maximum of 15 minutes beyond the reserved time. Late arrivals may result in reduced dining time or reallocation of the table.

8 Intellectual Property

All content on the Sunexo Restaurant website, including but not limited to text, graphics, logos, images, photographs, recipes (in part or whole), menu designs, trade marks, and software, is the exclusive intellectual property of Sunexo Restaurant or its licensors and is protected by Indian and international copyright, trademark, and intellectual property laws.

You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any materials from our website without prior written consent from Sunexo Restaurant. The "Sunexo" name, logo, and all related marks are registered trademarks and may not be used without explicit permission.

9 Notification and Communication Consent

This consent covers service-related updates (order confirmations, delivery updates, reservation reminders), promotional offers, seasonal menus, event invitations, loyalty program communications, and feedback requests. Transactional communications will be sent regardless of marketing opt-out status, as they are essential for service delivery.

10 User-Generated Content

If you post reviews, comments, photographs, or other content on our website, social media platforms, or feedback channels, you grant Sunexo Restaurant a non-exclusive, royalty-free, worldwide, perpetual, and irrevocable license to use, reproduce, modify, adapt, publish, translate, distribute, and display such content in any media without compensation or prior notice.

You represent and warrant that any content you submit is original, accurate, does not infringe on any third party's rights, and is not defamatory, obscene, or otherwise objectionable. We reserve the right to remove any user-generated content at our sole discretion without prior notice.

11 Limitation of Liability

To the maximum extent permitted by applicable law, Sunexo Restaurant shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, goodwill, or other intangible losses, resulting from (a) your use of or inability to use our services; (b) any food delivery delays or errors; (c) unauthorized access to or alteration of your data; (d) any actions or conduct of any third party on our platform; or (e) any other matter relating to our services.

Our total liability for any claim arising out of or relating to these terms or our services shall not exceed the amount you paid to Sunexo Restaurant in the twelve (12) months preceding the event giving rise to the claim.

12 Indemnification

You agree to indemnify, defend, and hold harmless Sunexo Restaurant, its directors, employees, partners, agents, suppliers, and affiliates from and against any and all claims, demands, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to your use of our services, your violation of these terms, or your violation of any rights of another party.

13 Force Majeure

Sunexo Restaurant shall not be liable for any failure or delay in performing its obligations under these terms where such failure or delay results from circumstances beyond our reasonable control, including but not limited to natural disasters, pandemics, government actions, wars, civil unrest, strikes, power outages, internet disruptions, supply chain failures, or any other force majeure event.

14 Governing Law & Dispute Resolution

These Terms and Conditions shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions. Any disputes arising out of or related to these terms shall be subject to the exclusive jurisdiction of the courts of New Delhi, India. Before initiating any legal proceedings, you agree to attempt to resolve the dispute through good-faith negotiation with us for a period of at least 30 days.

15 Modifications to Terms

Sunexo Restaurant reserves the right to modify, amend, or update these Terms and Conditions at any time without prior notice. Changes will become effective immediately upon posting on our website. Your continued use of our services after any modifications constitutes your acceptance of the revised terms. We encourage you to review these terms periodically.

16 Severability

If any provision of these Terms and Conditions is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it valid and enforceable, or if modification is not possible, shall be severed from these terms. The remaining provisions shall continue in full force and effect.
